Genius…or criminal…what do you think?

Ok so I was at the hot springs in Desert Hot Spring (yeah I am crazy b/c it is usually like 115 degrees there but this was in the morning so it was like 90) and this lady starts talking to me.  She went on whine about how the bank “took her house” and that she had to declare bankruptcy (this is within 20 seconds of meeting me, btw).  She continued to try to make me feel bad for her by telling me about how all of her credit cards canceled her.  “I used to have every credit card,” she bragged.  So, basically she is not the brightest crayon in the box and unquestionably not a talented money manager to say the least, I know.

She went on to boast about her son…and tell me that he is such a ‘genius’.  Why, you may ask?  Well she told me her son knew he was ‘under water’ with his house a few years back.  So, he willfully decided to ‘take out as much as he could’ on his house (maybe he had a line of credit and the bank didn’t rescind the line in time so he maxed it?) and then proceeded to pay cash for a new house (that was ‘way bigger and better’) and just ‘let the other one go.’  She told me, ‘he is the smartest guy in the world.’  In CA you can ‘walk away’ from a loan without repercussions, I’ve been told.

So, ok, admittedly many people did get ‘over their heads’ a few years back when the banks tried hard to convince everyone to ‘Tap into your home equity’ and that ‘Your house is your cash cow” and that is about as far as I will ever go agreeing with Michael Moore.  Not all of us fell for this, but Countrywide and many other banks did try hard to convince us.    That situation is different.

What her son deliberately did was inexcusable IMHO!  The whole time she was telling me this story I really thought the act was criminal, not genius (though I didn’t tell her this b/c she was bigger than me and probably could’ve kicked my behind).  I know it isn’t ‘technically’ against the law but it is still criminal in my eyes.

What do you think?

This is a common practice and, yes, it is criminal. People start businesses with the idea of running it into the ground and milking it for all its worth and letting its creditors high and dry. There is little repercussion for doing this. These criminals affect our interest rates and our economy.

Yes Francine! That's what I'm sayin' :) Let business owners operate 'their' business the way they want-we as consumers can choose to go there or not :) And there is always the gym the next day-that Latin Heat class kicks me in the behind everytime :) Good luck on your diet and have a good time tonight-I lost 77 lbs. 8 years ago and had a 'cheat night' every week and still lost/kept the weight off-it's good for your metabolism to 'change it up a bit.'

I have been dieting for 2 months, on the rare occasion I go out for a meal, please , no one tell me, tonight I am going to a beer and burger fundraiser for a friend with cancer, yes I'd rather it were a salad and diet ice tea fundraiser , but its not , I don't want to know the calories, thank you very much interfering government.

BTW I love CA but I think the state is not 'pro-business'. For example, a recent law requires that restaurants w/ 20 or more locations to include the calories of each item 'front and center' on the menu. I haven't had a banana cream pie shake from Sonic since (and trust me, you don't even wanna know how many calories). This new law has caused dimished sales at so many restaurants I've been told (by people who know what they are talkin' about or at least act like they do). I can't even order anything half the time I go out anymore (if I wanna know I'll ask to see how many calories-I don't need the state forcing the restaurant to preach to me on the menu).

Thanks Francine and I'm glad that there are laws like that there! Linda that is great, good for you! Chris, thanks for your insight and I agree :) (I've been studying too, btw) Everyone around here hates the banks and blames the banks for all of their issues. It's really 'sad' :( Most people here in CA would probably feel that her son is some hero.

its technically against the law here in Canada, the term for it is theft by conversion , and here a lean would be slappped on the new house faster than you can say Judge Judy
