The moral authority of our most cherished institutions comes from their voluntary nature: the value of advice from a priest, a teacher or a loved one depends in large part on the fact that we are free to ignore it. But judges' pieces of 'advice' are court orders, enforceable ultimately by the raw physical power of imprisonment. It is precisely because of the awesomely enforceable nature of our powers that we must be so circumspect in exercising them. It is one thing for a co-worker, family member, doctor, or clergyman to confront someone about a perceived drug problem; it is quite another thing for a judge to compel drug treatment. Drug courts not only fail to recognize this important institutional distinction, but their very purpose is to obliterate it.

We have to trust the courts to work it out in a fair and equitable way.

Never deceive the media or the public. Credibility is all we have to go on. Nothing gets done without total commitment and outrage mixed with political realism. Never assume anything: Check everything out yourself, at the source. Establish the credibility that when we start something, we finish it. With such track record, we then move to bigger struggles and more significant victories. No congressional bill or legal gimmickry by itself will save the animals. The courts can, at best, open up the possibility for us to intervene in defense of animals, but the courts will not act until effective protests disrupt the system's orderly operation.

If there has been any crime, it must be prosecuted. If there has been any property of the United States illegally transferred or leased, it must be recovered. I propose to employ special counsel of high rank drawn from both political parties to bring such actions for the enforcement of the law. Counsel will be instructed to prosecute these cases in the courts so that if there is any guilt it will be punished; if there is any civil liability it will be enforced; if there is any fraud it will be revealed; and if there are any contracts which are illegal they will be canceled. Every law will be enforced. And every right of the people and the Government will be protected.

As records of courts and justice are admissible, it can easily be proved that powerful and malevolent magicians once existed and were a scourge to mankind. The evidence (including confession) upon which certain women were convicted of witchcraft and executed was without a flaw; it is still unimpeachable. The judges' decisions based on it were sound in logic and in law. Nothing in any existing court was ever more thoroughly proved than the charges of witchcraft and sorcery for which so many suffered death. If there were no witches, human testimony and human reason are alike destitute of value.

Neither the doctrine of separation of powers, nor the need for confidentiality of high level communications, without more, can sustain an absolute, unqualified presidential privilege of immunity from judicial process under all circumstances. The President's need for complete candor and objectivity from advisers calls for great deference from the courts. However, when the privilege depends solely on the broad, undifferentiated claim of public interest in the confidentiality of such conversations, a confrontation with other values arises. Absent a claim of need to protect military, diplomatic or sensitive national security secrets, we find it difficult to accept the argument that even the very important interest in confidentiality of Presidential communications is significantly diminished by production of such material for in camera inspection with all the protection that a district court will be obliged to provide.

In order to form correct habits, we should seek the company of persons of sound moral and religious influence. We should constantly bear in mind that we may be fitting to inhabit the heavenly courts. The precious hours of probation are granted that we may remove every defect from the character; and we should seek to do this, not only that we may obtain the future life, but that we may be useful here. Young men and women should regard a good character as a capital of more value than gold or silver or stocks. When the history of the Supreme Court in the 20th century is written, there will be two great chief justices: Earl Warren and William Rehnquist. Both presided over courts that changed the law in a very dramatic way.

A new constitution should be more amendable. A needlessly confusing system of courts should be altered to produce an arrangement that would be simple, responsible, and less awkward.
